XMG Page XMG Belt-Fed AR-15/M16 Upper Receiver UPDATE 1/3/2009: We were recently notified by BATFE in a letter dated 12/23/08 that the XMG upper receiver assembly may only be used with semiautomatic lower receivers unless registered on an ATF Form 2 as a dealer sales sample by a licensed manufacturer and Special Occupational Taxpayer. We're seeking clarification on this issue and direction on possible modifications to the existing design. If you have any questions regarding this ruling, please contact BRP CORP at 301-807-5234. UPDATE 10/14/2009: The version pictured below (submitted to FTB in 02/09) was also classified as a "receiver" on 9/28/09. Our belief that our XMG upper receiver was classified differently than similar designs based on the buffer system was wrong. BATFE Firearms Tech Branch ruled that this upper receiver too is a "receiver" because it "is a copy of the MG34, and the receiver of the MG34 is the portion that the barrel is attached to and which also houses the bolt assembly and operating system.... As submitted, the assembled firearm has two receivers. Further, because the submitted XMG09 is attached to an M-16 style machinegun receiver, this constitutes the making of a new, post-1986 machinegun." As the previous version, it may be used in combination with semi-automatic lowers without any special registration.
An alternate assembly in 223 and/or 762X39, different from other firearm receiver designs, will be submitted to FTB soon. Given the wording and specifications in the recent letter, we think that our new design will be classified as a 'non-receiver' / 'non-firearm' like every other upper receiver for the AR family; and may then be used on transferable M16 machineguns. Once we get this through FTB, we'll come up with some type of trade-in and/or discount program for our pre-2009 customers.
